These days, perhaps because I have three small kids, I prefer getting up before them to work on my main task for the day. I even get a kick out of following people on Instagram who celebrate rising before the sun. According to Daniel Pink, author of the New York Times best-selling book When: The Scientific Secrets of Perfect Timing, I've changed from being a night owl to a lark, a common experience for many in their mid-thirties. A lark prefers to rise early whereas a night owl gets his or her best work done in the evenings. If you have teenagers, you're probably living with a night-owls. How Larks And Night Owls Work"Everybody who's not an owl tends to move through the day in three stages: a peak, a trough, a recovery," Pink said. "Owls tend to hit their peak much later in the day—late afternoon, early evening, well into the evening." Whether you're a lark or night owl, embrace your peak state. These valuable hours are ideal for focusing intensely on a difficult project for an extended period. "It's so important to use that time effectively...and not spend it answering email [or] wasting brain cells on Twitter." As a lark, Pink added, "When I'm writing books, or anything of any length, I sequester the morning and work only on that and then do my other work other times of day." This peak state typically lasts about three to three-and-a-half hours. Then you could either stop for lunch, a walk or even a nap. A trough period is better spent on administrative work. "I move my administrative work, that is...answering emails or expense reports to the trough period during the early to mid-afternoon," said Pink. "That's when I'm least effective, so I should do the least important stuff there." Expect a recovery in mental energy toward the end of a typical workday, a time ideal for brainstorming and other creative work. "That's a very valuable period," Pink said. "Our mood goes back up, but we're less vigilant, and that ends up being a very powerful combination for things that require some degree of mental looseness, flexibility, disinhibition." Getting Up Early Vs. Working LateIt's fashionable for entrepreneurs to extol the virtues of waking up early, but a lark doesn't hold any special advantage over a night owl. Instead, entrepreneurs should seek self-knowledge about when they're least and most energized and structure their workday accordingly. Pink recommends asking yourself, "What time of day am I most creative? At what time of day am I most mentally acute? How do I feel at two o'clock in the afternoon? Why is that different from the way I feel at 9:30 in the morning?" It's also a good idea to wrap up each workday with a little self-reflection. Review what you accomplished and when. Document what you worked on, accomplished and learned. Tracking your progress will help you become more productive the following day. "The single biggest day-to-day motivator on the job is making progress, and the trouble is that we often don't know when we're making progress," said Pink. "If you take that moment to reflect you realize, 'Hey, wait a second. I actually did get something done.' But it looks like New Jersey, the 11th biggest state in the country, may be on the verge of legalizing marijuana. The operative phrase in the above is “may be.” While Gov. Philip Murphy, a proponent of legalized marijuana during his campaign for governor, and leading state legislators have come to an agreement on a way to regulate and tax marijuana, more debate is expected as the state Legislature takes up the issue. At stake is what is projected as a billion-dollar marijuana industry in the Garden State. There are other ramifications as well, such as the fact that legal weed in New Jersey may push New York lawmakers to make it legal in that state faster. Where things standIn New Jersey, the current issue is getting a bill through the state Legislature that would legalize recreational marijuana. Even if it moves through quickly, sales in New Jersey would likely not start until 2020. But will it will move through quickly? Or at all? Proponents think legalization could be approved as soon as March. “And so now we finally have an agreement in principle on tough issues like regulation and taxation. Then we must convince a majority to support it. So we’re closer than we’ve ever been,” Scott Rudder, president of the New Jersey Cannabusiness Association, told Leafly. On the other hand, if there is a long delay with debate, more legislators may become acquainted with the arguments against legalized weed - or, at least, that is the hope of opponents such as this columnist with the Asbury Park Press. Republicans, however, are united - in opposition. State Sen. The Securities and Exchange Commission's allegation that Tesla CEO Elon Musk is in contempt of the federal court that approved a settlement between Musk and the agency is highly unusual, former SEC senior counsel Thomas Gorman told Business Insider. Being in contempt of court means either misbehaving in a courtroom or deliberately disobeying a court order (the SEC is accusing Musk of the latter). The SEC rarely brings contempt proceedings, Gorman said. "There just aren't very many of these cases around." It's particularly rare for the SEC to bring contempt proceedings against a corporate executive, rather than the operator of an illegal enterprise like a Ponzi scheme, Gorman said. The SEC sued Musk in September, alleging that Musk made "false and misleading statements" in August about the possibility of taking the automaker private. Musk and the agency reached a settlement in September, under which Musk didn't admit or deny the allegations in the agency's lawsuit but stepped down as the chairman of Tesla's board of directors for three years and paid a $20 million fine. The settlement also required Tesla to monitor Musk's communications, including on platforms like Twitter. But in the months after the settlement, Musk took aim at the SEC, saying in an interview with "60 Minutes" that he didn't respect the agency. And, on February 19, Musk tweeted a projection about Tesla's 2019 vehicle production that exceeded what the automaker had said in its most recent earnings letter. Musk corrected the tweet, but the SEC said in a court filing on Monday that Musk had violated the terms of his settlement with the agency by not seeking or receiving approval from Tesla before publishing his tweet about vehicle production. The agency asked a judge to hold Musk in contempt of the federal court that approved the settlement. But proving that Musk violated the terms of the settlement will be difficult for the SEC, which faces a burden of proof just below what is necessary for a criminal case, Gorman said. "The SEC has to prove they're right by clear and convincing evidence. It's not enough to have a preponderance." The most likely outcome is that Musk is sanctioned, fined, and given a stern warning about the consequences of disobeying his settlement with the SEC, said Peter Haveles, a partner at Pepper Hamilton. "It's going to be the equivalent of hitting him across the head with a two by four in order to get his attention."

VMware and Microsoft are working on a new cloud partnership, quietly teased in December. And this could help Microsoft as it seeks to overthrow Amazon's lead in cloud computing. That's because VMware and Amazon Web Services are also major partners. And, in a rare role-reversal, Amazon is considered somewhat dependent on the VMware partnership to push its all-important cloud business into the next big thing known as "hybrid" cloud. Hybrid is when companies keep some of their apps in their own data centers and use the public cloud for others, all of it engineered to work happily together. AWS is the leader in public cloud but VMware is the king of private data centers and hybrid computing, with half a billion customers. The AWS/VMware duo has been widely seen as a way for Amazon to stay in front of a fast-growing Microsoft Azure cloud business. But partnering with Amazon is like swimming with a scorpion on your back. Amazon never hesitates to compete with its partners. AWS routinely launches its own services that compete with those who use or sell their wares on its cloud. Amazon even competes with some of its biggest AWS customers like Netflix. Once VMware's customers move their apps to Amazon's cloud, there's nothing to stop Amazon from trying to upsell those customers to Amazon's home-grown technology, the next-generation stuff that upends VMware's bread-and-butter technology. In fact, in December, Amazon released just such a service, called Firecracker. https://www.youtube.com/watch?v=8GoX9h_gD3M And, interestingly enough, it was also in December that Microsoft and VMware quietly teased information about a partnership that will put VMware's flagship hybrid cloud software on Microsoft Azure, a similar thing as its partnership with AWS. The VMware/Azure service was still in "preview" mode, where customers can kick the tires, the two companies said. They didn't say when this service would be generally available. But six people told the Information's Kevin McLaughlin, that the two may announce details, and even a broader partnership, in a matter of weeks. VMware and Microsoft have been arch rivals for decades even though they have also partnered up as needed over those years. And in its blog post about the new Microsoft Azure partnership, VMware made it very clear that the company feels no more a sense of monogamy toward AWS than AWS feels toward VMware. Ditto for Microsoft. Ajay Patel, the VMware's exec responsible for VMware's cloud products, pointed out in the post that VMware is also partnering with IBM's cloud, European cloud provider OVH, Rackspace, CenturyLink and will do so with "others come to market," he said. What is Project Oxygen?Project Oxygen was a research study at Google that had relatively inauspicious beginnings. Developers at the company had long complained about bad management stifling innovation, so Google’s People Innovation Lab decided to conduct an experiment: Its principals hired statisticians to evaluate the differences between high- and low-rated managers. Included in that analysis was data from past performance appraisals, employee surveys, and interviews. Some observers assumed that the Project Oxygen analysis would prove that manager quality does not impact individual team members' performances. Others thought it would impact individual performance. Unsurprisingly, the latter camp was right. What were the findings?Specifically, Project Oxygen’s results showed that manager quality does have an impact on performance. And to confirm its findings, the Project Oxygen survey, first conducted in 2008, was repeated and refreshed, in 2018. Following are the top 10 behaviors Google’s People Innovation Lab concluded that its best managers shared (with the bolded behaviors on the list coming from the 2018 study specifically). The first thing the company did was revamp its employee-feedback surveys. Previously, those surveys had focused on manager output. But Google started including questions about whether, in the view of the employees involved, managers spent time coaching the team, communicated a clear vision, etc. The next step was to refresh the management culture itself. Every manager at Google was made aware of Project Oxygen’s results and took steps to align himself or herself with the 10-point list. According to Michele Donovan, head of People Operations at Google, the key finding from the project could be summed up as, “Having a good manager is essential, like breathing," she told Laszlo Bock (former head of People Operations at Google) for his book Work Rules. Added Donovan: "If we make managers better, it would be like a breath of fresh air.” How you can improve your own management culture.Since Google did the hard work for other companies by identifying "great manager" traits, you may now find it a lot easier to improve the management culture at your own organization, using that same 10-point checklist. But first ask yourself these crucial questions: 1. What’s your leadership or management style?When I asked Marvin Chow, VP of marketing at Google, how he hires, he answered, “We hire the best, and people who are culture fits.” This simple mantra has allowed him to surround himself with high performers. It also makes it easier for him to coach and mentor them. How do you interact with the team you’re managing? How do you treat each employee under your supervision? Do you encourage and motivate or micromanage and criticize? Micromanaging doesn’t really work in the long run; it’s more of a Band-Aid than a remedy for poor performance. But none of these benefits is possible if a manager doesn’t start by building trust: “The foundation of empowerment for me is building a culture of trust within the team," Burkhard said. "If the team feels like they have a level of safety and trust and know that coaching and feedback are coming in the spirit of improvement ... they actually feel very empowered to make those decisions. "Even if they make mistakes along the way, they know that it’s a process of growing.” 3. How do you coach employees when they are struggling?All too often, middle managers inadvertently create a culture of mistrust, where people are afraid to speak up. This kind of attitude really causes problems when employees are struggling because they’ll probably try to hide it rather than ask for help. Too often we think that the ultimate goal of team empowerment is to help the team (and by extension the team leader) operate at peak efficiency. OBS 23 is live: How to get better livestreams with Nvidia’s encoder https://ift.tt/2tAY9Hg Setting up a high-quality livestream is an expensive and complicated task, but Nvidia is working to address that by partnering with popular livestreaming tool developer Open Broadcasting Software (OBS). Traditionally, the quality goal for a broadcaster on Twitch or YouTube is to encode a live video with the CPU-powered X.264 encoder at “medium” speed. This creates an image where text is sharp and motion looks smooth. The problem is that this is so taxing on the CPU that it will either cause your game to run slower or you will need a second PC dedicated exclusively to encoding the livestream. Nvidia, however, has long had an alternative called NVENC (Nvidia encoder) that it built into its graphics cards. This option transcodes video on the GPU instead of the CPU, and it does so with a much smaller performance hit to your games. This has also had its problems, however. In the past, NVENC never looked as sharp or smooth as X.264 at medium at the upload bitrate that Twitch supports. But Nvidia has updated its NVENC tech in its latest generation of video cards. The RTX GPUs now broadcast live video at a quality level that matches or exceeds X.264 in most cases — even at lower bitrates. Now, in partnership with Nvidia, OBS has launched version 23.0 of its tool that includes a more efficient version of NVENC. You can download OBS 23.0 right here. While RTX cards, including the $350 RTX 2060, all have the improved hardware NVENC, Nvidia and OBS also squeezed new optimizations for every recent generation of GeForce GPUs. This changes the B-frame dynamically, which can be useful for getting sharper quality from low-motion games. Unfortunately, water protection isn't always a given, though that is changing for newer phone models. If you're on the market for a new phone, getting a phone that's more water-resistant to being full-on submerged in water can provide peace of mind. (For what it's worth, no current phone is "waterproof" since none are completely impervious to water damage.) But for those who are interested in a Google Pixel, here's what you need to know about the water-resistant specs for the phone's three iterations: The original Google Pixel is not waterproof or water-resistantHollis Johnson/Business Insider If water protection is a key feature, keep looking: The original Google Pixel phone is not waterproof or water-resistant. But if you're looking to buy a brand new phone through the manufacturer, you don't have to worry about this at all: Google doesn't sell the original Pixel model (or the first XL) anymore. Google Pixel 2 models are water-resistant to a degreeHollis Johnson/Business Insider According to Google, Pixel 2 models have a "water-resistant metal unibody with a grade of IP67," under standards from the International Electrotechnical Commission (IEC), which sets the standards for things like waterproofing and dust-resistance. "IP67" means that the Pixel 2 can be submerged in up to a meter of water for up to half an hour, according to Trusted Reviews. (For those of us not yet on the metric system, that's about three feet.) So while the Pixel 2 isn't 100% waterproof in all situations — and you shouldn't necessarily try to use it underwater — it can handle those common occurrences where your phone just slips out of your hand and into the kitchen sink. (Or wherever, no judgement.) It also comes with a two-year warranty if you buy the device through Google. Keep in mind, however, that the charger and any accessories to the phone are not waterproof or water resistant, according to Google. The Google Pixel 3 is slightly more water-resistantHollis Johnson/Business Insider The Pixel 3, Google's latest iteration of the phone, has a rating of IP68, which means that it's slightly more water-resistant than its predecessor. It can withstand being submerged in up to 1.5 meters for 30 minutes, according to Trusted Reviews. Again, the water-resistance doesn't apply to the phone's charger or accessories. But having that extra bit of protection may be a good idea for those who suffer from slippery fingers around expensive electronic devices. Especially if you're the type of skip on insurance, or yours doesn't cover water damage. How the Pixel 3 stacks up to its competitionFor comparison's sake, both the upcoming Galaxy S10 and the iPhone XS carry the same IP68 rating as the Pixel 3. But Samsung specifies that the Galaxy S10 is rated only for freshwater. Apple, on the other hand, has said that its IP68-rated iPhone XS has a maximum depth of two meters. Waterproofing is just one of many, many specs that help make a phone worth the expense. And on that point, Google's Pixel 3 rating is right up there with the other new phone models. But before you go forward with any purchase, be sure to check whether or not the warranty covers water-related damage — some manufacturers (Samsung, for instance) won't replace your phone if it ends up getting waterlogged. And maybe pick up a waterproof case while you're at it.

The Dirk Nowitzki farewell tour continued on Monday when Los Angeles Clippers head coach Doc Rivers made a classy gesture to the 40-year-old legend. With just 9 seconds remaining in the Clippers' 121-112 win, Rivers called a sudden timeout. He then got on the PA mic and told fans to give Nowitzki an ovation. It was the latest instance of the NBA world paying respect to Nowitzki, who is considered the greatest European player, an MVP, champion, top-10 all-time scorer, 14-time All-Star, and future Hall of Famer. There is just one problem with this outpouring of love — Nowitzki has never said he's retiring. Nowitzki will turn 41 this offseason and is in the last year of his contract. He's become one of the least mobile players in the NBA, something about which he frequently jokes. Naturally, he's now less effective on the offensive end and a liability on the defensive end. Still, as opposed to Dwyane Wade, who signaled that this season would be his "last dance," Nowitzki has never made an official retirement announcement. He even joked after the Clippers game that fans are deciding for him. "They're making the decision for me, I guess," Nowitzki said (via ESPN's Tim MacMahon). "We'll see what the rest of the season brings, but it's been great. I mean, really emotional in some of these buildings. The reception from the fans has been incredible. Much love, for sure." As on Monday, Nowitzki has received ovations in opposing arenas, with opponents frequently being asked about his impact on the game and the league. Even NBA Commissioner Adam Silver seems to be pushing Nowitzki out. During his 2019 All-Star Weekend press conference, Silver was asked about including Nowitzki and Wade on the All-Star rosters as honorary members — Wade has announced this is his last season; Nowitzki hasn't — and cracked a joke about Nowitzki's mobility. "I saw him painfully running up and down the court, and I think it was clear that this was going to be his last season," Silver said.
